Matthew Wieder will not be going to trial on 2 felony second degree assault charges, after the Strafford County Attorneys office says conflicting stories by the victim left them without proof beyond a reasonable doubt that he committed the assault and have decided not to procecute. Wieder was indicted by a grand jury in 2011 that he cut Denise Davis’ face with a piece of glass, causing permanent scarring and lacerations, while the two were staying at Wieders cabin in Barrington. Davis, a Colorado resident, was in town for a wedding at that time and stayed at that cabin with Wieder, the brides daughter and her boyfriend. Davis originally claimed that Wieder attacked her with a piece of glass after she brushed off his sexual advances. Upon returning to Colorado, she said that he used a rock with a piece of glass imbedded in it and also offered conflicting stories on how the attack unfolded. Wieder told police he had no recollection of the incident due to alcohol consumption. The alleged weapon was never found.
